Rooker-Feldman

A recent decision of the Federal District Court for the Northern District of Illinois makes the point that for the Rooker-Feldman doctrine to bar a federal court FDCPA case, the defendant in the state court action must have had a reasonable opportunity to raise the issues in the state court action.  The Federal Court concludes that a forcible detainer (eviction) action doesn’t give the defendant a reasonable opportunity to raise FDCPA claims.  Thus Rooker-Feldman doesn’t bar the federal court action.  Case here.
