I find this opinion troubling.  The debtor sues the debt collector for FDCPA violations.  The debt collector answers and files a counterclaim for the underlying debt.  The Federal Court dismisses the counterclaim as permissive counterclaims, rather than compulsory counterclaims.  Given the debtor’s claims about the underlying debt, I don’t understand the counterclaim not being compulsory.
