The offensive use of the FDCPA and Rule 11

I am seeing more and more reported cases, such as this, where creditors and their lawyers are pursuing attorney’s fees under the FDCPA and sanctions under FRCP 11 after beating back FDCPA claims.  Given that most of the Plaintiffs are of limited means, I am not sure that this does much good.  I’ll keep an eye out and see if the trend continues.
